Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Zzzon mobile application ("App" or "Service") operated by SereneArc LLC ("SereneArc," "we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the App.

1. About Zzzon

Zzzon is a sleep wellness app that offers audio-based challenges and journaling tools designed to help users with occasional sleep difficulties. Our challenges use a technique called paradoxical intention, which involves redirecting attention to help ease sleep anxiety.

IMPORTANT — PLEASE READ CAREFULLY:

  • Zzzon is a wellness tool, not a medical device. It is not intended to diagnose, treat, cure, or prevent any medical condition, including sleep disorders.

  • Zzzon is NOT appropriate for individuals who are in crisis, experiencing suicidal ideation, or in acute psychological distress. If you or someone you know is in crisis, contact emergency services (911) or a crisis hotline immediately, such as the 988 Suicide and Crisis Lifeline (call or text 988 in the US).

  • If you have chronic insomnia, a diagnosed sleep disorder, or a mental health condition, consult a qualified healthcare professional before using this App.

  • We do not guarantee improved sleep, reduced anxiety, or any specific outcome from use of the Service. Results vary significantly between individuals.

2. Eligibility

To use Zzzon, you must:

  • Be at least 13 years of age (or the minimum legal age in your country)

  • Be at least 18 years old to make purchases, or have parent or guardian consent

  • Have the legal capacity to enter a binding agreement

  • Not be prohibited from using the Service under applicable laws

  • Not be currently in psychiatric crisis, experiencing suicidal ideation, or receiving inpatient mental health treatment (see Section 1 for crisis resources)

3. Account Registration

3.1 Creating an Account

You may sign up using Apple Sign In or an email address. You agree to provide accurate, current information, maintain the security of your credentials, and accept responsibility for all activity under your account. Notify us immediately of any unauthorized account access.

3.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials. SereneArc LLC will not be liable for losses arising from unauthorized access due to your failure to protect your credentials.

3.3 One Account Per Person

Each person may maintain only one account. Creating multiple accounts to circumvent access restrictions is prohibited.

4. The Zzzon Service

4.1 Free Tier

Free accounts include access to one challenge per category (Cognitive, Story, and Knowledge) and unlimited ZzzLog journaling.

4.2 Premium Subscriptions

Premium access unlocks all available challenges. Current subscription options:

  • 3-Day Pass: $0.99 (expires after 3 days)

  • Monthly Subscription: $5.99 per month

  • Annual Subscription: $24.99 per year

Pricing is subject to change with reasonable advance notice.

4.3 Purchases and Billing

All purchases are processed through the Apple App Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. To cancel, manage your subscription through your Apple ID account settings. Refunds are handled per Apple's refund policy. SereneArc LLC does not process refunds directly.

4.4 Promotional Codes

We may issue promotional codes for testing or user research compensation. Codes have no cash value, are non-transferable, and are subject to any terms specified at issuance.

5. User Content — ZzzLog

5.1 Your Content

ZzzLog allows you to create private sleep journal entries ("User Content"). You retain ownership of your content. By creating User Content, you grant SereneArc LLC a limited, non-exclusive, royalty-free license to store and display it solely to provide the Service to you.

5.2 Privacy of ZzzLog Entries

In the current version of Zzzon, all ZzzLog entries are private. We will not share your journal entries with other users without your explicit consent.

5.3 Content Standards

You agree not to create User Content that is illegal, harmful, contains others' personal information without consent, promotes dangerous activities or self-harm, or interferes with the Service.

5.4 Content Deletion

You may delete ZzzLog entries at any time through the App. Deletions are processed promptly, though residual copies may temporarily remain in backup systems.

5.5 Data Deletion Rights

You have the right to request deletion of your personal data, including ZzzLog entries, under applicable data protection laws (including GDPR and CCPA). See our Privacy Policy and Section 11 for details on how to exercise this right.

6. Acceptable Use

You agree not to:

  • Use the Service in violation of applicable laws

  • Attempt to gain unauthorized access to any part of the Service

  • Reverse engineer, decompile, or disassemble the App

  • Use automated scripts or bots to access the Service

  • Interfere with or disrupt the integrity or performance of the Service

  • Reproduce, sell, or resell any part of the Service without written permission

  • Attempt to circumvent subscription limitations

  • Use the Service in a manner intended to harm yourself or others

7. Intellectual Property

The Zzzon App — including all audio content, narrations, scripts, challenge designs, the Zzzon character, visual design, branding, and technology — is owned by SereneArc LLC or our licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

If you provide feedback or suggestions, you grant SereneArc LLC the right to use that feedback without restriction or compensation to you.

8. Health and Wellness Disclaimer

By using Zzzon, you acknowledge and agree that:

  • Zzzon is not a substitute for professional medical advice, diagnosis, or treatment

  • You should consult a healthcare professional before using Zzzon if you have a diagnosed sleep disorder, anxiety disorder, or other mental health condition

  • The paradoxical intention technique may not be effective for everyone

  • We make no representation or warranty that the Service will improve your sleep, reduce your anxiety, or produce any other specific health outcome

  • Results vary; individual responses to audio challenges and journaling techniques differ significantly

  • If you experience worsening symptoms, discontinue use and consult a healthcare professional

  • Zzzon is not crisis support. If you are in crisis, please contact emergency services or the 988 Suicide and Crisis Lifeline immediately

9. Privacy

Your use of Zzzon is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully to understand our data collection, use, and retention practices.

We may use your information, including usage activity, as described in our Privacy Policy to analyze and improve the Service.

10. Third-Party Services

Zzzon integrates with Apple (authentication and payments), RevenueCat (subscription management), and Firebase (data storage and analytics). Your use of these services is subject to their respective terms and privacy policies. SereneArc LLC is not responsible for third-party practices.

11. Account Termination and Data Deletion

11.1 Termination by You

You may delete your account at any time through App settings. Upon deletion, your personal data will be handled per our Privacy Policy. Active subscriptions must be cancelled separately through your Apple ID settings before deleting your account.

11.2 Termination by Us

SereneArc LLC reserves the right to suspend or terminate your account if you violate these Terms, your use poses a risk to others, or as required by law. Upon termination for Terms violation, we have no obligation to refund unused subscription time.

11.3 Data Rights on Termination

Upon account deletion, we will delete or anonymize your personal data within 30 days, except where we are required by law to retain it. Anonymized, aggregated analytics data may be retained. See our Privacy Policy for full details.

12. Disclaimers and Limitation of Liability

12.1 Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, SERENEARC, LLC DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SERENEARC, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR DATA. OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12.3 Exceptions

Some jurisdictions do not allow certain liability limitations. In those jurisdictions, our liability will be limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify and hold harmless SereneArc LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or User Content you create.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

14.2 Informal Resolution

Before initiating formal proceedings, you agree to contact SereneArc LLC at privacy@zzzonapp.com and attempt to resolve the dispute informally for at least 30 days.

14.3 Arbitration

If informal resolution fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in California. Each party shall bear its own costs, subject to AAA rules.

14.4 Small Claims Exception

Notwithstanding the arbitration agreement above, either party may bring an individual claim in small claims court if the claim qualifies for that court's jurisdiction. This small claims exception does not permit class or representative proceedings in small claims court.

14.5 Class Action Waiver

YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. ALL CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS PROCEEDING.

15. Changes to These Terms

SereneArc LLC reserves the right to modify these Terms at any time. We will provide notice of material changes by updating the Effective Date and Last Updated date above and, where appropriate, by in-app notification. Continued use after the effective date constitutes acceptance. If you do not agree to updated Terms, delete your account.
